We see in this passage how, even though shaped only in the minds of human beings, the state seems to take on a real form and perform a real function with respect to the ethical striving towards wellbeing. After the sovereign body has been (from a phenomenological perspective) installed, laws become synonymous with the rules decreed by this body. The function of laws in this context is till psychological in the sense that they are firmly attached to a promise to ‘those who support the law what people most love and a threat to those who would break the law with what they most fear’ (TTP 4 [6–7], G III/59/5–10). The notion of law, then, as it ends up being framed within the context of civil society is but a means of control, much like ‘you might rein in a horse’, and should be conceptualized in this context as a ‘principle of living prescribed to men by the command of others’ (TTP 4 [6–7], G III/59/5–10).
